If you've had a buyer ghost you, write an offer with somebody else, or go straight to the listing agent — this is why. Most agents show first, explain later, and hope to get paid. That model is broken. If you show homes before you establish your value, you've already lost control of the relationship.

And if you don't set expectations before the showing, the buyer will ghost you, use another agent, call the listing agent directly, or wander into new construction and disappear entirely.

Get clear about what's actually happening. Buyers are not disloyal. They're uncommitted. And if you don't create the commitment, somebody else will.

Today we walk through the buyer consultation process that turns a stranger into a signed exclusive representation client — plus the one-time showing bridge, the fire-me-anytime risk reversal, and why the post-Sitzer-Bernett rules just handed a permanent advantage to the professionals.

The old model — show, explain, hope

Here's the process that produced pain for a whole generation of agents. Lead generate → show a bunch of homes → explain the buyer agency later → hope the buyer signs → get ghosted when they don't.

Sometimes the ghosting shows up as complete radio silence. Sometimes it's "my brother-in-law's an agent, we're going to use him." Sometimes it's "we ended up buying from new construction and they said we didn't need an agent." Sometimes it's "we already put in an offer with the listing agent directly."

All of these outcomes trace back to the same root cause. The agent never actually built the relationship, established the value, or earned the commitment before spending 20 hours driving the buyer around. The showings themselves were free samples the buyer had no reason to convert into a paid engagement.

The professional model — the buyer consultation

Here's the process Tim and Julie ran when they were actively selling — during the years their team was closing between 100 and 200 homes annually with a rotating group of buyer agents.

Every buyer went through the same 5-step process:

  1. Lead generation — inbound call, sign call, referral, sphere contact.

  2. Phone pre-qualification — thorough script call before any appointment was scheduled.

  3. Formal appointment set — at the office, in a professional conference room, in a controlled environment.

  4. Buyer consultation delivered — walking through the entire process, USPs, differentiation.

  5. Exclusive buyer agency agreement signed — before any home was shown.

Not every buyer needed the full presentation. Most looked at the professionalism of the setup and said "sign, sign, done." But the fact that the presentation existed — that the process was formal, structured, and professional — is what produced the "sign, sign, done" outcome.

Compare that to walking into a Starbucks with a stranger, chatting for 20 minutes, and hoping they'll sign something. Completely different dynamics. Completely different close rates.

What actually goes in the buyer consultation

The presentation covers, at minimum:

  • Unique selling propositions. What separates your team, your brokerage, your process from every other agent in the market.

  • The full buying process. From offer through negotiation through inspection through closing.

  • Working with builders. Most buyers don't understand that builders will still pay a buyer agent commission if you accompany the buyer on the first visit — but only then.

  • Working with FSBOs. How you handle for-sale-by-owner situations.

  • How negotiation works. So the buyer understands why they need a skilled negotiator on their side rather than negotiating directly with a listing agent whose fiduciary duty runs to the seller.

  • How home inspection works. Setting expectations for the process.

  • What your commission structure looks like and how it's paid.

  • What their commitment to you looks like in the exclusive buyer agency agreement.

Every question they'd have raised at a Starbucks conversation is answered systematically inside a professional presentation. Which means when you get to the closing question — "do you have one or two questions or are you ready to get started now?" — the closing is the logical ending to a great presentation, not a separate ask that catches them off guard.

Handling the buyer who won't commit — the one-time showing bridge

Here's the tactical piece almost no agent has figured out yet. What do you do when a buyer refuses to sign the exclusive?

You've pre-qualified them. You know they're a real buyer. But they're skeptical. Maybe they've been burned before. Maybe they just want to see how you operate before committing. Maybe they're introverts who need slower relationship-building. Whatever the reason — they're not signing today.

The wrong move is to fight them or walk away. Both cost you the buyer.

The right move — the one-time showing bridge.

How the bridge actually works

  1. Get them to sign a one-time showing agreement for a specific single property (or two).

  2. Have them meet you in the car, not at the property or following behind. This is critical.

  3. Show them one or two carefully-selected properties that reflect their pre-qualification answers.

  4. Before you show anything, negotiate the next-meeting commitment:

"Listen — I completely understand you want to make sure I'm the agent for you before signing an exclusive. That's fair. So let's do this. Let's agree that I'll show you these one or two properties on a one-time showing agreement so you can see how I operate. And let's also agree that at our next meeting — where we'll actually formalize working together — you'll be signing the exclusive buyer agency agreement with me. Fair?"

Roughly 9 out of 10 buyers will say yes to that setup.

The maybe-1-in-10 who won't agree at all are usually revealing that they're already working with someone else, or that they intend to shop multiple agents against each other. Better to know now than to invest 20 unpaid hours before they disappear.

Why keeping them in your car matters

Old-school move that most modern agents have abandoned for no good reason. Have the buyer ride in the car with you between properties.

Two things happen simultaneously in that shared car time. One — you get to know them better through conversation that wouldn't happen at a property. Their kids' names. Their timeline. Their real motivation. Their concerns. Two — they bond with you through shared time, low-pressure conversation, and demonstrated professionalism.

Neither of those things happens when they follow you in their own car.

Especially in the AI era — where direct human contact is becoming the single most differentiated experience an agent can provide — the shared car ride is one of the highest-value relationship-building windows available. Meanwhile, competing agents are texting their buyers "meet me at the property in 20 minutes" and wondering why they can't close the exclusive on the second meeting.

The fire-me-anytime risk reversal

For buyers who are worried about getting locked in to an agent who might turn out to be a dud — build in a specific escape clause. The fire-me-anytime guarantee, with specific exclusions.

The pitch:

"Mr. Buyer, I'm so confident you're going to love the job I do for you when I'm actually showing you properties that I want to give you full risk reversal. If for any reason you decide you don't want to work with me, you can fire me — no cancellation fee, no strings attached. Only exclusion — any property I've already shown you or any builder I've already introduced you to remains covered under our agreement. If you buy one of those, our agreement applies. Everything else, you can walk away clean."

Now the exclusive buyer agency agreement becomes a selling point instead of an obstacle. The buyer sees you're confident enough in your value to let them go if they're not satisfied. That confidence itself is what earns them.

Meanwhile, the exclusion clause protects you from the specific abuse pattern of buyers who tour your inventory, fire you, and buy from someone else at a property you introduced them to.

The Sitzer Bernett verdict is final — now what

Related legal update most agents haven't fully absorbed. There were seven separate appeals to the Sitzer Bernett settlement. All seven were consolidated into a single case rather than being litigated individually. And roughly last week, the judge upheld the settlement across the board.

Buyer agency agreements are not going away. Not this year. Not next year. Not ever. Whatever hope some agents were holding that the rules might revert to the old sign nothing, show everything model — that hope died last week.

Which means the professional move is to stop wishing the rules were different and start using them as a competitive advantage. Because here's the truth almost nobody in the industry is naming clearly enough. Every one of your competitors now has to get an exclusive signed too — by law. Which means:

  • The agents who can present professionally and earn the exclusive win.

  • The agents who can't will keep getting one-time showings and keep watching their buyers disappear to new construction, listing agents, and FSBOs.

The new rules haven't handicapped good agents. They've handicapped bad ones. Which is a permanent gift to the professionals.

The pre-qualification script

Foundation of the entire buyer consultation. The pre-qualification call happens before the appointment is even scheduled. Not a script to memorize word-for-word — a conversation outline that surfaces motivation and commitment. Sample questions:

  • "Mr. Buyer, how long have you been searching for a property?"

  • "Six months. Wow, that's a long time. Have you seen anything you've liked during that time?"

  • "Really? What did you like about those houses?"

  • "Just to be clear — you and I are speaking today because you're not currently working with another realtor, correct?"

  • "If any of those three properties you liked were still for sale, would you consider buying one of them?"

Notice what's happening. You're extracting the buyer's real motivation, their previous search behavior, their agent commitments, and their honest willingness to write an offer — all in one call. By the time they show up to the formal presentation, you know exactly who they are and exactly what they need.

And critically — they've done the emotional work of answering thoughtful questions from a professional who cares about their answers. That single dynamic differentiates you from every other agent they've spoken to.

"You were the only one who asked about me"
